Environmental Impact Assessment & Clearance Certificate (ECC)

Legal Requirement — Section 27, EMA 2007: It is an offence for any person to undertake, commission or finance a listed activity without an Environmental Clearance Certificate (ECC). Listed activities include mining, construction, energy generation, agriculture, tourism developments and industrial activities. Proceeding without an ECC carries criminal penalties.
Phase 1: EIA Registration & Scoping
Project description form submitted to the Environmental Commissioner — project name, location, description, scale
Draft Terms of Reference (TOR) for the EIA process
Identification and notification of all Interested and Affected Parties (I&APs)
Background Information Documents (BIDs) prepared and distributed to stakeholders
Public meeting announcements in local newspapers (minimum 21 days notice)
Scoping Report compiling key issues, specialist study requirements and methodology
Phase 2: Full EIA Report
Baseline environmental study: soils, vegetation, fauna, hydrology, socio-economics, cultural heritage
Impact assessment: identify and evaluate all significant positive and negative impacts
Mitigation measures: proposed steps to eliminate, reduce or manage each identified impact
Specialist studies as applicable: biodiversity, heritage, hydrology, noise, air quality, social impact
Alternatives considered: site, design, technology, no-development option analysis
Public participation records: meeting minutes, I&AP comments and proponent responses
Environmental Management Plan (EMP): construction, operational and decommissioning phases
Monitoring programme: key indicators, responsible parties, reporting frequency
Financial assurance for environmental rehabilitation (where required by the Commissioner)
Submission to Environmental Commissioner
3 hard copies + digital copy (USB/CD) of the full EIA report
MET prescribed application form and processing fee payment
30-day public review period (managed by IBDFN)
Proponent response to public and authority comments (if requested)
ECC issued within 65 working days of complete submission (statutory timeframe)
