Mining Claim Registration & Pegging
Authority: Ministry of Mines & Energy — Mining Commissioner's Office
Act: Minerals (Prospecting & Mining) Act No. 33 of 1992, Part IV · Portal: mme.gov.na
Legal Requirement: No person may peg a mining claim or extract minerals without a valid licence under the Minerals Act No. 33 of 1992. Illegal mining is a criminal offence under Section 2 of the Act, punishable by fines and imprisonment. All claims must be registered with the Mining Commissioner within 30 days of pegging.
Documents Required — Mining Claim Registration
Completed Mining Claim Application Form — available from the Mining Commissioner, MME Windhoek
Valid Namibian ID or passport (certified copy) of the applicant
If applying as a company: BIPA company registration certificate (certified)
NamRA tax clearance certificate (current)
Detailed description of the claim area with GPS coordinates of all corner beacons (WGS84 datum)
Sketch map or diagram of the pegged area showing bearings and distances between beacons
Photographs of each pegged beacon (minimum 4 photos per claim, with GPS metadata)
Completed pegging record form — filled in on-site at the time of pegging
Declaration that no conflicting registered claim exists over the area
Registration fee payment (confirm current rate at MME at time of application)
Pegging Technical Requirements
Corner beacons: clearly marked posts minimum 1 metre high, placed at each corner of the claim
Maximum claim size is determined by the type of mineral and current regulations — confirm with MME
Claim must not overlap any existing registered claim, national park, proclaimed conservancy or excluded zone
All coordinates recorded in WGS84 geographic datum using a calibrated GPS device
Claim registration number to be painted on the primary beacon after confirmation from MME
IBDFN's surveyors conduct pegging to exact MME technical specification — errors in pegging void registration
